1. Nature of This Software

Kalshi Bot ("the Software") is an automated trading tool designed to interact with the Kalshi prediction market exchange via its public API. The Software is provided strictly as a technical utility. It is not a financial advisor, investment advisor, broker, or dealer. Nothing in the Software or accompanying documentation constitutes investment advice or a recommendation to buy or sell any contract.

2. No Guarantee of Profit

• The Software places orders based on configurable algorithmic parameters. Market conditions change; no algorithm performs consistently under all conditions.
• Backtested or paper-traded results do not guarantee identical live performance.
• Slippage, latency, API outages, and market regime changes can all result in losses exceeding your expectations.

3. User Responsibility

By using the Software, you acknowledge and agree that:

• You are solely responsible for all trading decisions made via your account, including those executed automatically by the Software.
• You will comply with Kalshi's own Terms of Service and all applicable laws and regulations in your jurisdiction.
• You will configure risk parameters (daily loss limits, position sizes, kill switches) appropriately for your risk tolerance before enabling live trading.
• You will not use the Software for any unlawful purpose.

4. Limitation of Liability

To the fullest extent permitted by applicable law, the developers and operators of Kalshi Bot shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Software, including but not limited to trading losses, lost profits, or loss of data — even if advised of the possibility of such damages.

5. No Affiliation with Kalshi

This Software is an independent third-party tool and is not affiliated with, endorsed by, or sponsored by Kalshi Inc. "Kalshi" is a registered trademark of Kalshi Inc. Use of the name is solely for descriptive purposes.

6. Software Provided "As Is"

The Software is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The operators do not warrant that the Software will be error-free, uninterrupted, or free of security vulnerabilities.

7. Subscription & Refund Policy

Kalshi Bot is offered as a monthly subscription service billed through Stripe.

• Subscriptions renew automatically each month until cancelled.
• You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• All payments are non-refundable. We do not issue pro-rated refunds for partial months or unused subscription time.
• At our sole discretion, we may offer a complimentary month of service in exceptional circumstances (e.g. extended outages caused by us). This is not a guarantee and does not constitute a refund policy.

8. Changes to These Terms

These terms may be updated at any time. Continued use of the Software after changes constitutes acceptance of the revised terms.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law provisions.
